WC Liquor Authority investigates 97, suspends 34 licenses

21 July 2020 by Con Tributor

The Minister of Community Safety, Albert Fritz, welcomes the 97 investigations conducted by the Western Cape Liquor Authority (WCLA) between 27 March and 17 July 2020. Of these 97 investigations, 44 matters were placed on the Liquor Licensing Tribunal’s (LLT) case roll of which:

  • 34 licences were suspended;
  • 8 applications were dismissed; and
  • 2 applications are pending.

Minister Fritz said, “I commend the WCLA on their consistent efforts to prevent alcohol related harms and ensure that there are enough beds in our hospitals for those who need it most during this difficult time. At the same time, I call on residents to report transgressions where they become apparent either to SAPS or the WCLA.”

Of the 34 licences that were suspended, 33 section 71(4) return hearings as well as further section 20 considerations on 13 of these matters took place of which:

  • 1 suspension was extended pending a section 20 consideration, while 30 suspensions were lifted by the LLT; and
  • 2 suspensions were lifted, one in the High Court and one as part of an internal Appeal Tribunal proceeding.

Minister Fritz added, “Of the 30 suspensions that were uplifted, these matters may be returned to the LLT in terms of section 20 for those cases where prima facie evidence exists for any contraventions in terms of the Western Cape Liquor Act.”

Minister Fritz continued, “I urge members of the public who are aware of the illegal sale of alcohol to immediately report such to SAPS. Any persons wanting to lodge a complaint or report a contravention of the Regulations can contact the WCLA on 021 204 9805 or visit https://www.wcla.gov.za/.”
